1. Interpretation

Buyer/Customer: the person, firm or company who purchases goods or services from CureAll Pharmacy.

Company: CureAll Pharmacy, AMBE House, Commerce Way, Edenbridge TN8 6ED.

Contract: any contract between the Company and the Customer for the supply of goods or pharmacy services.

Goods: any medicines or products agreed in the Contract to be supplied to the Customer.

Words in the singular include the plural and vice versa. A reference to a particular law is a reference to it as it is in force taking account of any amendment, extension, or re-enactment.

2. Application of Terms

These terms and conditions govern all transactions and interactions with CureAll Pharmacy, to the exclusion of all other terms and conditions. By placing an order you are deemed to accept these terms.

Each order placed by the Customer shall be deemed an offer to purchase, subject to these conditions. No order is accepted until we issue a written acknowledgement or dispatch the goods.

Any quotation is valid for 7 days only from its date, provided it has not previously been withdrawn.

3. Description of Goods

All goods are described as accurately as possible. Product descriptions, images, and specifications are for guidance only and do not form part of the contract unless expressly stated. This is not a sale by sample.

We reserve the right to substitute equivalent medicines where a specific product is unavailable, in accordance with pharmacy regulations.

4. Prescription Medicines

Prescription-only medicines (POMs) are dispensed only upon receipt of a valid prescription from a registered prescriber. By ordering prescription medicines you confirm that:

We reserve the right to refuse any prescription that we believe may be fraudulent or inappropriate.

5. Delivery

Delivery takes place at the address provided by the Customer at the time of ordering. Any discrepancies or damages must be notified in writing within 2 days of delivery.

Delivery dates are estimates only. We are not liable for delays beyond our reasonable control. The Customer must ensure someone is available to receive temperature-sensitive medicines.

If delivery fails because the Customer has not provided correct instructions or is not available:

6. Returns and Refunds

Due to the nature of pharmaceutical products, we are unable to accept returns of medicines once they have left our pharmacy, except in the following circumstances:

No return will be accepted without prior written authority from the Company. Returns must be carriage paid unless the fault is ours. No credit or exchange will be allowed for goods with less than 6 months' shelf life upon return, goods that require temperature-controlled storage, or goods not purchased directly from CureAll Pharmacy.

7. Risk and Title

Goods are at the risk of the Customer from the time of delivery. Ownership of goods does not pass to the Customer until full payment has been received in cleared funds.

8. Pricing and Payment

All prices are in GBP and include VAT where applicable. We reserve the right to change prices at any time without notice, but changes will not affect existing confirmed orders.

Payment is due at the time of ordering unless credit terms have been agreed in writing.

9. Privacy and Data

We handle all personal data in accordance with our Privacy Policy and GDPR obligations. We will never sell your personal data to third parties.

10. Limitation of Liability

CureAll Pharmacy shall not be liable for any indirect, consequential, or economic loss arising from the use of our products or services, except where such loss arises from our gross negligence or wilful misconduct.

Our total liability to the Customer in respect of any one event or series of connected events shall not exceed the value of the goods giving rise to the claim.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

11. Regulatory Compliance

CureAll Pharmacy is registered with the General Pharmaceutical Council (GPhC) and operates in full compliance with UK pharmacy law, including the Human Medicines Regulations 2012. All medicines supplied are sourced from MHRA-licensed suppliers and manufacturers.

12. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We reserve the right to update these terms at any time. Changes will be posted on this page with a revised date. Continued use of our services constitutes acceptance of the updated terms.
